Handsfree Legislation
SAFETY IS MORE IMPORTANT THAN ANY PHONE CALL -
IS IT WORTH THE RISK ?
It is illegal to:
Hold a mobile phone while driving, this includes cradling
the phone on your shoulder, or holding it by any other means.
Hold a mobile phone any time the car's engine is switched on, even if the car is stationary, whether to make or take calls, send text messages, or any other function.
Hold a mobile phone while supervising a learner driver.
Cause or permit anyone else to use a handheld mobile phone while driving.
This new law doesn't apply if you dial 999 or 112 in response to a genuine emergency and cannot stop safely to make a call.
2-way radios are not covered by this offence but other devices for sending or receiving data (e.g. navigation aids, personal digital assistants (PDAs) or other computer equipment) are covered by the offence if they are held when driving.
Can I still make calls while driving?
You can continue to use handsfree kits while driving as long as the phone is not held while your engine is switched on.
Handsfree kits include:
Fully-integrated car kits with cradles
Bluetooth® handsfree kits
Bluetooth® headsets
If you are caught using a mobile phone whilst driving, you are likely to receive a minimum of
a 60.00 fine and 3 penalty points on your license. However this would
be increased if you was involved in an accident whilst using a mobile phone
